    Here is what I know about trademarks. First, the assumption--likely correct--is that the trademarks of the various railroads absorbed into the CN corporate umbrella are indeed registered and that CN now owns the rights to them. Second, if CN does own the trademark rights, then they may regulate or prohibit their use by outside entities. Now, this third thing I am not so sure about. Years ago, I was told that, if a trademark (in the U.S.) was not used for some extended period of time, the trademark owner could lose exclusive rights to it. This came up back in the late 1990's when some obscure UP gons (that were also using D&RGW reporting marks) showed up all repainted and shiny with newly applied "Rio Grande - Mainline through the Rockies" heralds on them. I was told by a railroad official that was done to demonstrate that the registered trademark was, indeed, still in use by its owner. If that use was, in fact, done to preserve the trademark rights, then it might follow that "heritage" repaints are not only nostalgia for PR purposes, they also may serve a legal function.
